Welcome to My3Dpro. By accessing and using our online architectural drafting services, you agree to be bound by the following terms and conditions. Please read them carefully.
Instruments of Service encompass both tangible and intangible work, including:
1. Scope of services
1.1. Service Description: My3Dpro provides professional architectural and construction document drafting services online. Our services are based on the information, design concepts, and program requirements provided by the client. The specific services and deliverables for your project will be outlined in a separate project agreement or proposal.
1.2. Exclusions: Our online services explicitly exclude site visits, site analysis, code verification (beyond general review), and direct communication with regulatory bodies, unless specifically included in your project agreement as an additional service. The client is responsible for verifying that all plans comply with local, state, and federal building codes, zoning regulations, and other ordinances.
2. Client responsibilities
2.1. Provision of Information: The client is responsible for providing all necessary and accurate information, including property surveys, site dimensions, design requirements, and any other relevant data. My3Dpro is not responsible for errors or omissions resulting from inaccurate or incomplete information provided by the client.
2.2. Approvals: The client must provide timely feedback and final approval for each design phase. Delays in client feedback may impact the project schedule.
2.3. Independent Verification: The client is responsible for having the final plans reviewed by a licensed professional in their local jurisdiction and by their chosen building contractor prior to construction.
3. Intellectual property
3.1. Ownership of Instruments of Service: My3Dpro retains all common law, statutory, and other reserved rights, including copyright, in the drawings, specifications, and all other documents created for the project ("Instruments of Service").
3.2. Client License: Upon final payment, the client is granted a non-exclusive license to use the Instruments of Service solely for the purpose of constructing the specific project at the specific site identified in the project agreement.
3.3. No Reuse: The Instruments of Service may not be reused for any other project, renovation, or addition without the express written consent of My3Dpro. Any unauthorized use is a violation of the Architect's copyright.
3.4. Marketing Rights: My3Dpro reserves the right to use photographic or artistic representations of the design for promotional and professional materials.
4. Compensation and payment
4.1. Fee Structure: The fee for services will be detailed in a separate project agreement.
4.2. Payment Terms: Most services provided by My3Dpro require full payment prior to work begins. In the event of a large and complex project totaling $10,000 or more, a separate client agreement will be created and the payment schedule will be outlined in that project agreement. Payments can be structured as deposits, milestone payments, or installment plans.
4.3. Non-Refundable Payments: All payments are non-refundable. This policy reflects the professional labor, expertise, and resources expended in generating custom architectural designs and documents.
4.4. Additional Services:Any services requested by the client that fall outside the defined scope of work will be billed as additional services at a rate specified in our pricing structure. 5. Standard of care and limitation of liability
5.1. Standard of Care: My3Dpro will perform its services consistent with the professional skill and care ordinarily provided by architectural drafters practicing in the same or similar locality under similar circumstances.
5.2. Limitation of Liability: The client agrees that My3Dpro's liability for any and all claims, damages, or disputes, including those arising from professional negligence or errors in the Instruments of Service. Contractor performing the physical build is responsible for verifying all conditions and measurements prior to performing work. My3Dpro holds no liability for inconstancies or errors between drawings/renderings and on site or real world conditions.
5.3. No Warranty: We provide our services on an "as-is" basis, and we offer no warranties, express or implied, regarding the final construction cost, contractor performance, or the final quality of materials and labor. We have no control over said details.
6. Disclaimers for online services
6.1. Site Visits: My3Dpro performs most services remotely. We do not inspect the project site and are not responsible for any issues related to existing site conditions or discrepancies between the information provided and actual site conditions. This does not exclude our on site consultation service. We may provide you with an on site consultation(if needed) to better understand your project and project needs or to gather information required to perform our services. In the event we provide you with an on site consultation we still hold no liability for any issues related to site conditions. Contractor is responsible for verifying any and all site conditions we may provide for the project ("Instruments of Service").
6.2. Permitting Services: The client is solely responsible for all permit applications, approvals, and fees required by authorities having jurisdiction unless we agree in writing, have billed to perform this service, and have received payment.
6.3. Information Provided "As Is": Any information, including estimated timelines or construction costs, is for informational purposes only and is not a binding guarantee.
7. Dispute resolution: Any dispute arising from or related to this agreement shall be subject to mediation as a condition precedent to binding dispute resolution. If the dispute is not resolved through mediation, it shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association.
8. Termination
8.1. Termination for Cause: We may terminate any agreement or obligations for any reason with written notice.
8.2. Payment Upon Termination: In the event of termination, the client shall pay for all services and expenses incurred by My3Dpro up to the termination date. No refunds will be issued.
9. Acceptance of terms By clicking "I agree," completing a transaction, or otherwise using our services in any form, you acknowledge that you have read, understood, and agree to these terms and conditions.
Payment and Refund PolicyAll payments made to My3Dpro for architectural drafting services are due prior to work begins and are non-refundable. This policy reflects the investment of time, professional expertise, and resources required to produce the client's custom deliverables.
Project Payments: All fees are due prior to work begins as outlined herein. Each payment compensates for the services rendered up to that point and is considered final upon receipt of clients deliverables(excluding revisions).
Termination of Agreement: In the event of contract termination by the client, for any reason, the client agrees to pay for all services performed and expenses incurred by My3Dpro up to the date of written termination notice. No refunds will be issued for payments already made.
Right to Revisions: We are committed to delivering high-quality designs. Any necessary revisions to correct errors or inconsistencies in the documents provided by My3Dpro will be performed at no additional charge. This policy does not cover revisions resulting from changes in the client's design preferences. A maximum of three(3) revisions are included with the purchase of any drawings or renderings. Additional revisions will be billed separately.
